DISTANCE SALES CONTRACT

ARTICLE 1 - PARTIES

This Distance Sales Agreement (“Agreement”) has been concluded electronically between the parties with the following information.

ARTICLE 2 - DEFINITIONS

  • Platform: www.vartycoffee.com and mobile applications
  • Seller: Celalettin Bayar – Varty Coffee
  • Buyer: The natural or legal person who places the order.
  • Product: All goods and services ordered
  • Regulation: Distance Contracts Regulation

ARTICLE 3 - SUBJECT OF THE CONTRACT

The subject of this contract is the delivery of the product/service ordered by the Buyer through the platform and the determination of the rights and obligations of the parties.

ARTICLE 4 - PRODUCT INFORMATION, SALES PRICE, PAYMENT AND DELIVERY

The product name, quantity, price, payment method, and delivery information confirmed by the buyer on the order screen are used as the basis. Orders will be shipped within 30 days at the latest.

ARTICLE 5 - RIGHTS AND LIABILITIES OF THE PARTIES

  • The buyer declares that he/she has read and accepted all preliminary information.
  • The seller is obliged to deliver the products without defects, in full and in accordance with the contract.
  • There is no right of withdrawal for personalized products such as grinding.
  • In case of credit card cancellations, the product must be returned within 3 days.
  • In case of force majeure, delivery may be delayed or the order may be cancelled.

ARTICLE 6 - RIGHT OF WITHDRAWAL

The buyer may exercise the right of withdrawal without giving any reason within 14 days from the date of delivery. Notification can be sent to info@vartycoffee.com or vartycoffee@gmail.com. should be made to the address.

  • If the product is sent without exercising the right of withdrawal, the shipping cost belongs to the Buyer.
  • Product returns must be made with the original box, invoice and packaging.
  • Credit card refunds are made to the bank within 14 days after the refund request.

ARTICLE 7 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for the following products:

  • Ground or custom-made coffees upon consumer request
  • Products that have been opened and are not suitable for return due to hygiene reasons
  • Food, beverages, perishable or expiring products

ARTICLE 8 - DISPUTE CASE

The Consumer Arbitration Committee or Consumer Court in the Buyer's place of residence has jurisdiction.

ARTICLE 9 - NOTIFICATION

The e-mail addresses and addresses declared by the parties are accepted as legal notification addresses.

ARTICLE 10 - ENFORCEMENT

This agreement is deemed to have come into force as soon as the Buyer confirms it on the platform.
